Christian and Dolores were licensed to practice law in Kentucky in 2014 and 2016, respectively. The pair moved to Kentucky at the beginning of the COVID-19 pandemic. Their practice is focused exclusively on consumer and small business bankruptcy, although they do represent their bankruptcy clients in related non-bankruptcy legal matters.
Before becoming attorneys, Dolores was a performing artist and Christian was a musician. They were married and had a son in 1998. Together, they owned and operated independent restaurants in Brooklyn NY from 2000 to 2007. The pair were sued by investor/lenders in the restaurants. Christian taught himself some law and became adept at defending against very aggressive creditors.
The restaurants closed and the pair were saddled with significant business-related debts, including sales taxes and personally guaranteed business loans. It took 10 years to recover from the business failure and payoff business-related debts. At that time, the pair still had no idea that bankruptcy could have addressed a lot of their outstanding credit issues.
Christian and Dolores enrolled in law school and were exposed to bankruptcy law. Had the pair known about bankruptcy during the heat of their battle with their business creditors, their story would have been very different. It depends on income and expenses. Plan payments are based on the difference between income and reasonable monthly expenses. Most people don't know exactly what they can afford to pay because their finances are in shambles and hard to manage. The most important service provided is working carefully through monthly expenses and figuring out what's affordable. The goal is to propose a payment plan that can be maintained while maintaining a decent standard of living.
Thousands of Kentuckians file bankruptcy more than once in their lives because life circumstances change. Chapter 13 is available even if Chapter 7 was filed within the last seven years. It's not a failure—it's a legal tool designed to provide structure, protection, and a path forward.
If facing a repossession, an eviction, a foreclosure sale, or a utility disconnect, do NOT make any payments—file now. If not facing an emergency but sure about filing for bankruptcy within one month or so, stop making payments to any general unsecured creditors. Paying general unsecured creditors before filing bankruptcy is like burning money. It does not help credit and does not affect the balance. Keep making payments on mortgages or vehicle loans unless facing an emergency or advised not to make the payment.
